      Bee it knowne unto all men by thiese prsents that I John Cutting of Newb u ry in the County of Essex in New england being through gods mercy in he al th of body and of perfect memory. Considering seriously mine owne frai lt y and mortality, endeavouring to leave mine estate to my relations a s ma y continue loue & peace amongst them, I do hereby make my last Wil l and T estament, first I comend my Soule into the hands of my blessed Re deemer J esus Christ and my body when I shall decease this life, if I d y in ewbur y to be buryed in the burying place in Newbury in hope of a ha ppy resurre ction. And for my worldly goods I dispose of as followeth, fi rst I giue a nd bequeath unto mary my wife dureing her widdowhood, all m y Lands good s and chattels. And so will and appoint her my sole executri x of this m y last will and testament. But if my said wife shall change h er Conditio n and marry againe, then I order and appoint that she my sai d wife shal l pay yearely afterwards dureing her naturall life out of m y lands fiftee ne pounds a yeare. That is to say. To my Daughter Mary, th e wife of Nicho las Noyes fiue pounds a yeare, And to my
      Daughter Sara Browne of Charlestowne, the wife of James Browne, fiue pou n ds a yeare, and to my Grand child Mary–the wife of Samuell Moody, fiu e po unds a yeare, and also out of my stocke to every one of my Grand chi ldre n and great grand children thirty shillings a peice. And at the deat h o f the said Mary, my wife I giue & bequeath unto my said Daughter Mar y Noy es all that house and land now in the possession of Thomas Bloomfie ld tha t lyeth on the east side of the high way conteineing about fifty o r fiu e and fifty acres bee it more or lesse both vpland pasture land & m eado w and after my said Daughter Mary Noyes her decease to remaine and a bid e to the proper use of her Son Cutting Noyes, his heires & assignes f oreu er. 2dly I giue and bequeath vnto my Daughter Sara, the wife of Jame s Bro wne abousaid & her heires, all the house I now dwell in, with the t welu e acres of vpland that the house stands vpon, andthree quarters o f tha t twenty acres of Salt Marsh land lately purchased of Mr. Steuen Du mmer b ee it more or lesse. 3dly I giue and bequeath vnto my Grandchild M ary moo dy, the wife of Samuel moody abouesaid, all the house and Land th at is i n the possession of John Dauis with the six akers of meadow in th e Birche n meadows and the quarter part of the twenty acres of the salt m arsh lan d bee it more or lesse as is abouespecifyed, further I give vnt o her my s aid Grandchild Mary Moody, all that parcell of arable land lat ely purchas ed of the said mr. Dumer, lyeing vpon the southwest of the hi ghway betwee ne the land of Henry shorte on the southeast and John Knight s land on th e northwest conteineing about twenty or fiue twenty acres mo re or lesse . And the first yeare the said Samuell Moody, his heirs &c. s hall possess e the abouesaid parsell of Land which shalbe after my wive s decease, the n the said samuell Moody or his heirs shall pay to my Daug hter sara, th e wife of James Browne aforesaid the summe of forty pounds . But if my gra ndchild Mary moody abousaid shall dye without Issue of he r owne body, the n all the land abouespecifyed that is hereby given vnt o her, shall afte r her decease, Remaine equally tobee diuided vnto my a bouesaid two daugh ters Mary Noyes & sara Browne & their Children for eue r. And the forty po und that is here mentioned to be paid by Samuell mood y vnto my daughter S ara Browne abouesaid, if paid before, shall be pai d backe againe unto th e abouesaid Samuell Moody my Debts and funerall ri tes being discharged b y my said executrix.       1. Capt. John and Mary Ward Cutting had a son, John, Jr, noted as joint ⠀œ master” of the ship “Desire” of Boston in 1641. John Jr married , prior t o 1638, Mary (–) and they had a daughter Mary who married Sam uel Moor two are mentioned in Capt. John’s will. It is as sumed that Joh n Jr died prior to the writing of the will. It is well est ablished that C apt. John and his wife Mary had a daughter, Sarah, who ma rried, prior t o 1652, James Brown, born 1605 died 1676. They also are me ntioned in Capt . John’s will. Sarah subsequently married, 29 Nov. 167 7 at Newbury, Willi am Healey and, as a third husband, Sarah married, 0 3 Dec.1685 at Newbury , Hugh March. There is, maybe, another daughter, i. e., Judith who suppose dly married, in 1638, the above James Brown, as hi s first wife with Judit h dying prior to 1652. Recognized documentary sou rces are divided on whet her James Brown’s first, Judith, was a Cuttin g or a woman with a differen t surname.
